By accessing or using this Application, the User confirms that they have read, understood and agree to be bound by these Terms. Users who do not agree with these Terms must not use this Application.
Unless specified otherwise, these Terms apply generally to the use of this Application. Single or additional conditions of use applicable to specific Services, such as loan applications, rate locks or broker partner agreements, may apply in certain cases and are reported in this document or in a separate agreement provided to the User.
Where a separate written agreement exists between the Owner and the User, such as a loan agreement, disclosure package or broker partner agreement, that agreement shall prevail over these Terms in case of conflict.
Users may use this Application only if all of the following conditions are met:
• Users are at least 18 years of age or the age of legal majority in their jurisdiction;
• Users have the legal capacity to enter into a binding agreement;
• Users are not prohibited from using this Application or its Services under applicable law;
• Users access this Application in a jurisdiction where the Owner is permitted to offer its Services.
To use certain Services, such as the Client Portal or the TPO Portal, Users may be required to register or create an account and provide complete and truthful information.
Users are responsible for keeping their login credentials confidential and safe. Users must use passwords of reasonable strength and must not share their credentials with any third party.
Users are fully responsible for all activities that occur under their account. Users must notify the Owner immediately, using the contact details provided in this document, if they believe their account has been accessed without authorization.
Users may stop using this Application and request closure of their account at any time by contacting the Owner. Closing an account does not affect any loan application, loan agreement or other obligation already inplace between the User and the Owner.
The Owner reserves the right, at its sole discretion, to suspend or terminate a User's account at any time and without notice, if it considers such account to be inappropriate, offensive or in violation of these Terms. Such suspension or termination shall not entitle the User to any claim for compensation, damages or reimbursement.
This Application and the Service may only be used within thescope of what they are provided for, under these Terms and applicable law.
Users are solely responsible for making sure that their use of this Application and the Service does not violate applicable law, regulations or third-party rights.
In particular, Users must not:
• provide false, misleading or incomplete information in any loan inquiry, application, pricing request or other submission;
• impersonate any person or misrepresent their affiliation with any person or entity;
• use this Application to commit or facilitate fraud, money laundering or any other unlawful activity;
• attempt to gain unauthorized access to this Application, its systems, or any account, portal or data belonging to anotherUser;
• interfere with or disrupt the operation of this Application, including by introducing viruses, malware or other harmful code;
• use automated means, such as bots, scrapers or crawlers, to access, copy or collect content or Data from this Application without the Owner's prior written consent.
The Owner reserves the right to take any appropriate measure to protect its legitimate interests, including denying Users access to this Application or the Service, terminating agreements, reporting misconduct to the competent authorities and taking legal action.
Information on this Application about loan programs, including DSCR, ITIN and Conventional programs, is provided for general information only. Nothing on this Application constitutes an offer to lend, a loan approval, a commitment to lend or a rate lock.
Loan approval and rates depend on the applicant's credit, collateral, financial history and program availability at the time of origination. Programs and rates are subject to change without notice and may not be available at the time of loan commitment or lock-in.
The Quick Pricer, calculators and similar tools provided by this Application produce estimates based on the information entered by the User and on assumptions that may not reflect the User's actual situation. Results are not a Loan Estimate, a Closing Disclosure or any other disclosure required by law.
Users should not rely on these estimates when making financial decisions. Final terms are provided only in the official disclosures issued during the loan process.
Content on this Application, including the Mortgage Glossary and the Blog, is educational and does not constitute financial, legal, tax or investment advice. Users are encouraged to consult qualified professionals about their particular situation.

The User agrees to indemnify and hold the Owner and its subsidiaries, affiliates, officers, directors, agents, employees and partners harmless from and against any claim or demand, including legal fees and costs, made by any third party due to or in relation with:
• any culpable use of this Application or the Service by the User;
• the User's violation of these Terms;
• the User's violation of any third-party rights or applicable law;
• any false or misleading information provided by the User.
To the maximum extent permitted by applicable law, this Application and the Service are provided on an "as is" and "as available" basis. The Owner does not warrant that this Application will be uninterrupted, error-free, secure or free of viruses or other harmful components.
The Owner may need to suspend or interrupt this Application for maintenance, system updates or any other changes, informing Users appropriately where possible.
To the maximum extent permitted by applicable law, in no event shall the Owner be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, Data or goodwill, arising out of or relating to the use of, or inability to use, this Applicationor the Service.
Nothing in these Terms excludes or limits the Owner's liability where such liability cannot be excluded or limited under applicable law, including under federal and state consumer protection and lending laws.
By providing a mobile phone number and opting in, the User agrees to receive text messages from Legions Capital, Inc. at that number. Consent to receive text messages is not a condition of obtaining a loan or anyother Service.
Types of messages
Users who opt in may receive the following types ofmessages:
• loan application status updates and requests for documents;
• appointment and call reminders;
• rate lock, closing and other loan milestone alerts;
• account and Client Portal notifications;
• responses to inquiries the User has submitted.

After the User texts STOP, they will receive one final message confirming the opt-out and no further messages will be sent unless the User opts in again. Carriers are not liable for delayed or undeliveredmessages.

The Owner's failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.
The Owner reserves the right to transfer, assign, dispose of by novation, or subcontract any or all rights or obligations under these Terms, taking the User's legitimate interests into account. Users may not assign or transfer their rights or obligations under these Terms without the Owner's written permission.
Should any provision of these Terms be deemed or become invalid or unenforceable under applicable law, the invalidity or unenforceability of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
These Terms are governed by the laws of the State of California and applicable federal law of the United States, without regard to conflict of law principles.
The exclusive competence to decide on any controversy resulting from or connected to these Terms lies with the state and federal courts located in Los Angeles County, California, except where applicable law grants the User the right to bring a claim in their place of residence.
The Owner reserves the right to amend or otherwise modify these Terms at any time. In such cases, the Owner will appropriately inform Users of these changes on this page and, where technically and legally feasible, via any contact information available to the Owner.
Such changes will only affect the relationship with the User from the date communicated to Users onwards. The continued use of this Application after that date will signify the User's acceptance of the revised Terms. It is strongly recommended to check this page often, referring to the date of the last modification listed at the top.
